1. Custom Print Services
San Diego Printworks ("we," "us," "the Company") provides custom newspaper and tabloid printing services. All products are custom-made to order based on print-ready files supplied by the customer ("you," "the Client"). By placing an order, you enter into a binding agreement governed by these Terms & Conditions and the laws of the State of California.
2. Client-Supplied Files — Your Responsibility
You are solely responsible for the content, accuracy, and legality of all files submitted for printing. We do not proofread, spell-check, fact-check, or review your files for errors of any kind. We reproduce your submitted PDF exactly as provided. This includes but is not limited to:
- Spelling, grammar, and typographical errors
- Incorrect dates, names, addresses, or phone numbers
- Image resolution, color accuracy, and layout issues
- Copyright, trademark, or intellectual property compliance
- Compliance with applicable laws and regulations
By submitting your file and approving the order, you confirm that you have reviewed your document and accept full responsibility for its contents. We shall not be held liable for any errors in client-supplied materials.
3. All Sales Are Final — No Refunds or Returns
Because all products are custom-made to your specifications, all sales are final. We do not accept returns, issue refunds, or provide credits for completed orders. This policy is consistent with California Civil Code Section 1723(e)(1), which exempts custom-made and personalized goods from standard return policy requirements.
If we make an error in production (e.g., printing on the wrong paper stock, incorrect quantity, or mechanical defect not caused by your file), we will reprint the order at no additional charge. Claims for production errors must be reported within 48 hours of delivery with photographic evidence.
4. Pricing & Payment
All prices are calculated based on your uploaded PDF's ink coverage analysis, page count, paper type, finishing options, quantity, and delivery method. The quoted price at checkout is the final price. Payment is required in full before production begins. We accept payment via credit card, debit card, and other methods available through our payment processor (Stripe).
5. Chargebacks & Fraudulent Disputes
Filing a chargeback or payment dispute after receiving your completed custom order constitutes fraud. Under California Penal Code Section 484(a), obtaining goods or services through false pretenses is a criminal offense. Under California Penal Code Section 532, obtaining money, labor, or property by false pretenses is punishable by imprisonment.
If a chargeback is filed on a delivered order, we will:
- Contest the dispute with full documentation including proof of delivery, order confirmation, and your acceptance of these terms
- Report the incident as fraud to the appropriate authorities
- Pursue recovery of all costs including the order amount, chargeback fees, and administrative costs
- Reserve the right to pursue civil action for damages
We maintain records of all orders, file submissions, delivery confirmations, and accepted terms for dispute resolution purposes.
6. Delivery
Same-day and next-day courier delivery is available within designated San Diego delivery zones. Standard shipping is available nationwide. Delivery times are estimates and not guaranteed. We are not liable for delays caused by weather, traffic, carrier issues, or incorrect addresses provided by the client. Risk of loss passes to the client upon delivery to the specified address.
7. Production Timeline
Same-day orders must be placed before the posted cutoff time. Orders placed after the cutoff will be processed the following business day. We reserve the right to reject or delay orders that exceed our production capacity.
8. Intellectual Property
You represent and warrant that you have the legal right to reproduce all content in your submitted files, including text, images, logos, and designs. You agree to indemnify and hold harmless San Diego Printworks from any claims arising from the content of your materials, including copyright infringement, defamation, or violation of any third-party rights.
9. Limitation of Liability
Our total liability for any claim arising from your order shall not exceed the amount you paid for that order. In no event shall we be liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost business opportunities, or reputational harm.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California. You consent to the exclusive jurisdiction of said courts.
11. Modifications
We reserve the right to update these Terms at any time. Changes take effect when posted on this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
